General Terms and Conditions of Sale (GTC)

1. Purpose

These General Terms and Conditions of Sale (the “GTC”) govern all sales made on the website www.saiaacouture.com by saïaa, a sole proprietorship (micro-enterprise) registered with the Trade and Companies Register under SIRET number 909498032.

Any order placed on the website implies full and unconditional acceptance of these GTC by the customer.

2. Products

The products offered for sale are handmade caftans and traditional garments.

Each item is described as accurately as possible (photos, descriptions, available sizes, production times).
Photographs are non-contractual: slight variations in color or details may occur due to the handcrafted nature of the products.

3. Orders

The customer selects the desired items, adds them to the cart, and confirms the order.
Any order constitutes acceptance of the prices, product descriptions, and terms of sale.
A confirmation email is sent to the customer once payment has been validated.

4. Prices and Payment

Prices are indicated in euros, including all taxes (VAT), excluding shipping fees.
Shipping fees are specified at checkout.
Payments are secure and may be made by credit card, PayPal, or any other payment method offered on the website.
The order is considered final once full payment has been received.

5. Shipping and Delivery

Preparation times are 2 to 5 business days for in-stock items.
For pre-order or custom-made items, production times will be specified at the time of order.
Delivery is handled by third-party carriers (Colissimo, Chronopost, etc.).
Arabian Création cannot be held responsible for delays or losses caused by shipping carriers.

6. Right of Withdrawal and Returns

In accordance with the French Consumer Code, the customer has 14 days from receipt of the product to exercise their right of withdrawal.

Conditions:

  • The product must be returned in its original condition: unworn, unwashed, undamaged, and unstained.

  • Custom-made or personalized items are non-returnable and non-refundable.

  • Return shipping costs are the responsibility of the customer.

Once the product has been received and inspected, the refund will be issued within 14 days maximum to the original payment method.

7. Liability

Arabian Création shall not be held liable in the event of:

  • improper use of the products,

  • indirect damages resulting from the purchase,

  • disruptions or interruptions of the website.

8. Intellectual Property

All elements of the website (photos, texts, logos, design) are the exclusive property of saîaa and are protected by copyright law.
Any total or partial reproduction is strictly prohibited.

9. Personal Data Protection

Data collected during the ordering process is used solely for order processing and customer relations.
In accordance with the GDPR, customers have the right to access, rectify, and delete their personal data.

10. Governing Law and Disputes

These GTC are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the dispute shall fall under the jurisdiction of the competent French courts.
